User Agreement (Terms of Service)

This User Agreement (hereinafter referred to as the "Agreement") constitutes a binding offer to enter into a contract with anyone who accepts its terms and defines the terms of use of materials and services available in the application on the Internet at: https://app.nodiet.ai (hereinafter referred to as the "Application") by visitors and users of the Application (hereinafter referred to as "Users").
1. Definitions
1.1. Application Administrator — Individual Entrepreneur Maxim Dmitrievich Nagovitsin, contact email: support@nodiet.ai, who is the owner of the Application.
1.2. User — a legally capable individual who has reached the age of 18 (or another age established by the laws of their country of residence sufficient to accept this Agreement), using the Application.
1.3. Application — a collection of software and other information contained in an information system, access to which is provided via the Internet at the domain name https://app.nodiet.ai, including web and mobile versions.
1.4. Acceptance of the Offer — full and unconditional acceptance by the User of the terms of this Agreement, made by starting to use the Application, including but not limited to: viewing pages, registration or authorization, uploading photos, submitting forms, paying for services, and other actions using the Application's functionality.
2. Subject of the Agreement
2.1. The Application Administrator grants the User the right to use the Application and its services under the terms set forth in this Agreement. The subject of this Agreement is providing access to information materials and services of the Application.
2.2. This Agreement is a legally binding document for both the User and the Application Administrator.
2.3. The User confirms that they have read and agree to the terms of the Privacy Policy, which is an integral part of this Agreement.
3. Rights and Obligations of the Parties
3.1. The Application Administrator undertakes to:
3.1.1. Provide the User with access to the Application in accordance with the terms of this Agreement.
3.1.2. Ensure the confidentiality of information provided by the User in accordance with the Privacy Policy posted in the Application.
3.2. The Application Administrator has the right to:
3.2.1. Change the content of the Application at any time, as well as suspend or terminate access to the Application or its individual services for technical, preventive, or other work.
3.2.2. Modify or supplement this Agreement. Changes take effect from the moment the new version of the Agreement is published in the Application, unless otherwise specified.
3.2.3. Restrict access to the Application or its individual services in case of violation by the User of the terms of this Agreement.
3.3. The User undertakes to:
3.3.1. Comply with the terms of this Agreement.
3.3.2. Not use the Application for actions that violate applicable law, including the legislation of the User's country of residence.
3.3.3. Not take actions aimed at disrupting the normal operation of the Application, including attempts to gain unauthorized access to functionality, data, or servers.
3.3.4. The User has the right to delete their account and request deletion of their personal data by sending a request to the email address: support@nodiet.ai. The procedure for processing such a request is determined by the Privacy Policy.
4. Paid Services
4.1. The Application Administrator has the right to provide the User with paid services. Information about the cost and procedure for providing such services is posted in the relevant sections of the Application.
4.2. Payment for services is made by the User in the manner specified in the Application. The moment of payment is considered to be the receipt of funds to the Administrator's account or confirmation of payment by the payment service.
4.3. When purchasing paid services, the User undertakes to provide an email address to receive an electronic receipt in accordance with the requirements of applicable tax legislation. The Administrator ensures that the receipt is sent to the specified email address.
4.4. The User is responsible for the accuracy and relevance of the specified email address. If an incorrect or inaccessible email address is provided, the Administrator is not responsible for the User not receiving the electronic receipt.
4.5. Refunds: Refund requests are processed in accordance with applicable consumer protection laws. For refund inquiries, please contact support@nodiet.ai.
5. Intellectual Property
5.1. All objects placed in the Application, including design elements, text, graphic images, illustrations, videos, scripts, programs, and other objects and their collections (hereinafter referred to as "Content"), are objects of exclusive rights of the Application Administrator and/or other copyright holders.
5.2. Any use of the Application or Content, other than expressly permitted by this Agreement, without the prior written permission of the copyright holder is strictly prohibited.
6. Disclaimers and Limitation of Liability
6.1. THE APPLICATION AND ITS SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2. The Application Administrator is not responsible for any possible losses incurred by the User in connection with the use of the Application, except in cases directly provided for by the applicable law.
6.3. The User uses the Application and information obtained through it at their own risk.
6.4. IN NO EVENT SHALL THE APPLICATION ADMINISTRATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
6.5. Health Disclaimer: The Application is not a medical service and is not intended for diagnosing, treating, or preventing diseases. Information provided through the Application is for informational purposes only and does not replace consultation with a doctor or other qualified specialist. Always seek the advice of a qualified health provider with any questions regarding a medical condition.
7. Dispute Resolution
7.1. All disputes and disagreements that may arise between the Parties are subject to resolution through negotiations.
7.2. If it is impossible to resolve a dispute through negotiations, it is subject to resolution through a pre-trial claim procedure. The response time for a claim is 30 (thirty) calendar days from the date of its receipt.
7.3. Governing Law: This Agreement is governed by applicable law. Mandatory consumer protection laws of your jurisdiction apply to the extent they cannot be waived by agreement.
7.4. Jurisdiction: Any disputes arising from this Agreement that cannot be resolved through negotiation shall be submitted to the competent courts, taking into account mandatory jurisdictional rules of your country of residence.
8. Changes to the Agreement
8.1. The Application Administrator reserves the right to modify this Agreement at any time.
8.2. We will notify Users of material changes by posting a notice in the Application or by other appropriate means.
8.3. Continued use of the Application after changes are posted constitutes acceptance of the modified Agreement.
9. Final Provisions
9.1. This Agreement comes into force from the moment of acceptance of the offer by the User, that is, from the moment of starting to use the Application, and is valid indefinitely until it is revoked or replaced by a new version.
9.2. The current version of the Agreement is always available at: https://nodiet.ai/en/user-agreement.
9.3. For all issues not covered by this Agreement, the Parties shall be governed by the applicable law.
9.4. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
