User Agreement (Terms of Service)

Effective as of October 11, 2026

These Terms govern your use of nodiet.ai: the web app, the iOS and Android apps, the Telegram mini app and related services (the "Service"). By creating an account or using the Service you accept these Terms and confirm that you have read the Privacy Policy. For the Russian service these Terms are a public offer (Article 437 of the Civil Code of the Russian Federation), and using the Service is its acceptance.

1. Who provides the Service

1.1. nodiet.ai runs as two separate services:

  • International service — for users outside Russia (web app at eu-app.nodiet.ai and the iOS and Android apps for accounts registered with this service). It is provided by Iurii Menshikov, a private individual residing in Spain.
  • Russian service — for users in Russia (web app at app.nodiet.ai, the Telegram mini app and the iOS and Android apps for accounts registered with this service). It is provided by Individual Entrepreneur Maxim Dmitrievich Nagovitsin (Yekaterinburg, Russia; OGRNIP 325665800292355, INN 668602006513).

1.2. "We" means the provider of the service your account belongs to; section 1 of the Privacy Policy explains how the service is chosen. Where the two services differ, these Terms say so.

1.3. These Terms are published in English and Russian with the same content. If the versions differ, the English version prevails for the International service and the Russian version for the Russian service.

2. The Service

2.1. nodiet.ai is a food diary. You can log meals by photo, voice or text; the Service estimates calories and nutrients with AI, calculates daily goals, tracks water, weight and activity, and offers an AI assistant.

2.2. Not a medical device. The Service is intended for general wellness and nutrition tracking. It is not a medical device and does not diagnose, prevent, monitor or treat any disease. Talk to a doctor before changing your diet if you are pregnant or breastfeeding, have a medical condition or a history of eating disorders, or take medication that affects your appetite or weight.

2.3. AI estimates. Calories, nutrients and assistant replies are generated automatically and may be inaccurate. Check them and correct them where needed; you decide what to eat.

2.4. We keep developing the Service and may change, add or remove features. If a change significantly reduces what you have paid for, we will tell you in advance and you may cancel your subscription.

3. Your account

3.1. You must be at least 18 years old to use the Service.

3.2. You can use the app without signing in; your data is then linked to the device. Sign in to keep access to your data on other devices: with Apple or Google, and in the Russian service also with Telegram or Yandex ID. Available sign-in options may depend on the requirements of the law. You are responsible for keeping access to your sign-in account.

3.3. You can delete your account at any time in the app (Profile → Delete account). Deleting the account does not cancel a subscription bought through Apple or Google — cancel it in the store (section 4).

4. Free plan, subscription and payment

4.1. The basic features are free, with limits shown in the app (for example, on AI requests). Pro gives you more; its features are described in the app. The price, billing period and any free trial are shown in the app before you buy.

4.2. Automatic renewal. The subscription renews automatically for the same period at the then-current price until you cancel. After cancellation Pro stays active until the end of the period you have paid for. If a free trial is offered, it turns into a paid subscription at its end unless you cancel before then; a trial is available only once.

4.3. If we change the price of a subscription, we or the store will inform you in advance and, where required, ask for your agreement. A new price applies only from the next billing period.

4.4. International service.

  • Pro is bought only through the App Store (Apple) or Google Play (Google). Payment is charged to your store account and processed by Apple or Google under their terms. We do not receive your card details.
  • Cancel in your App Store or Google Play subscription settings; on the App Store, cancel at least 24 hours before the end of the current period to avoid being charged for the next one.
  • Right of withdrawal and refunds. If you are a consumer in the EU, you have a statutory right to withdraw from a purchase within 14 days. Apple and Google handle withdrawals and refunds under their terms: request them in the store (Apple: reportaproblem.apple.com; Google Play: your order history). If you have a problem with a purchase, write to us as well.

4.5. Russian service.

  • On the web and in the Android app installed from RuStore, you pay by bank card through YooKassa. In the Android app from Google Play, you can choose YooKassa or Google Play. In the iOS app, purchases are made through the App Store.
  • When paying through YooKassa, your card is linked for automatic renewal: we receive only a payment method identifier, the card type and its last four digits. To start a free trial we check the card by charging 1 rouble and refund it immediately. Before a charge we send a reminder if notifications are on.
  • You can turn off automatic renewal at any time in your profile; subscriptions bought through Google Play or the App Store are cancelled in the store.
  • The provider applies the professional income tax regime and issues receipts under Federal Law No. 422-FZ. Provide an email address to receive the receipt; we are not responsible for receipts not delivered to an incorrect or unavailable address.
  • Refunds. Refunds are made under the Law of the Russian Federation "On Protection of Consumer Rights": write to support@nodiet.ai; for purchases through Google Play or the App Store, refunds are handled by the store under its terms.

4.6. Nothing in these Terms limits the rights you have as a consumer under mandatory law.

5. Your content

5.1. You keep all rights to the photos, voice messages, texts and other content you add. You allow us to store and process it to provide the Service to you, as described in the Privacy Policy.

5.2. Products you add to the shared product catalogue (name, nutrition facts, photo) become visible to other users of the same service without your name. You allow us to show them in the Service while it operates; we remove them when you delete your account.

5.3. Add only content you have the right to share. Do not upload photos of other people without their permission or content that is illegal.

6. Acceptable use

You must not:

  • break the law or the rights of others through the Service;
  • try to access other users' data, our servers or features that are not available to you;
  • interfere with the Service, overload it or use automated means to access it, except through features we provide;
  • copy, resell or reverse-engineer the Service, except where the law allows this despite this restriction.

If you seriously or repeatedly break these rules, we may suspend or close your account. We will tell you why, unless the law prevents us, and you may contest the decision by writing to us. If we close your account for reasons other than a breach of these Terms, you will not be charged again, and we will refund the unused period or help you request it through the store.

7. Intellectual property

The Service, its design, texts, software and trademarks belong to us or our licensors. We grant you a personal, non-transferable and non-exclusive licence to use the Service for your own purposes under these Terms.

8. Our responsibility

8.1. We provide the Service with reasonable care and are liable as required by the law that applies to your service (section 10). The services you pay for must conform to these Terms; your statutory consumer rights in this respect are not limited.

8.2. We are not responsible for losses caused by AI estimates you did not check, by your decisions about food and health, or by events outside our reasonable control (for example, outages of app stores, payment and sign-in providers or networks).

8.3. We are fully liable for intent and gross negligence, for harm to life or health, and wherever liability cannot be limited by law. In the International service, for slight negligence we are otherwise liable only for breach of essential obligations and only for foreseeable damage.

9. Changes to these Terms

We may update these Terms when the Service, the law or our business changes. We will tell you about significant changes in the app in advance; the app will ask you to review the documents again. If you do not agree, you can stop using the Service, delete your account and cancel your subscription.

10. Law and disputes

10.1. International service: these Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim before the courts of that country or of Spain.

10.2. Russian service: these Terms are governed by the law of the Russian Federation. Disputes are considered by a court determined under Russian law; as a consumer, you can choose the court under the Law "On Protection of Consumer Rights".

10.3. Please write to us first at support@nodiet.ai. We answer claims within 10 days and other messages within 30 days.

10.4. If any provision of these Terms is invalid, the rest remains in force.

11. App Store

If you downloaded the app from the Apple App Store, the following also applies:

  • These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • The licence in section 7 allows you to use the app on Apple devices you own or control, as permitted by the Usage Rules of the Apple Media Services Terms.
  • Apple has no obligation to provide maintenance or support for the app; contact us for both.
  • If the app does not conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation for the app.
  • We, not Apple, handle any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and claims that the app infringes third-party intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must also comply with the terms of third parties you use with the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
